This document is an official public offer (offer agreement) of the Seller to enter into a distance sales contract for goods through the online store in accordance with Articles 633, 641, and 642 of the Civil Code of Ukraine.
This Agreement defines the terms and conditions for purchasing goods displayed on the website, as well as the procedure for placing orders, payment, and delivery of goods.
1. GENERAL PROVISIONS
1.1. The Seller sells goods through the online store located at: www.evangeline.in.ua
1.2. Placing an order on the website and/or payment for the goods constitutes full and unconditional acceptance (acceptance of the offer) of the terms of this Agreement by the Buyer.
1.3. By entering into this Agreement, the Buyer confirms that they:
have read and agree to the terms of this Agreement;
consent to the processing of their personal data in accordance with the current legislation of Ukraine;
are a legally capable person who has reached the age of 18.
2. TERMS AND DEFINITIONS
2.1. Online Store - the Seller’s website located at www.evangeline.in.ua through which goods are sold.
2.2. Buyer - an individual or legal entity placing an order in the online store for the purpose of purchasing goods.
2.3. Goods - clothing and other items offered for sale on the website.
2.4. Order - a properly completed request by the Buyer to purchase goods displayed on the website.
2.5. Acceptance - full and unconditional acceptance by the Buyer of the terms of this Agreement.
3. ORDER PLACEMENT PROCEDURE
3.1. The Buyer independently places an order through the online store or by using other means of communication specified on the website.
3.2. When placing an order, the Buyer undertakes to provide accurate information necessary for order fulfillment.
3.3. The Seller shall not be liable for failure to fulfill or improper fulfillment of the order if the Buyer provides inaccurate or incomplete information.
3.4. After placing an order, the Buyer may receive an order confirmation.
4. PRICE AND PAYMENT
4.1. The prices for the Goods are indicated on the online store website and may be changed unilaterally by the Seller.
4.2. The price of the Goods specified at the time of placing the order is final for that specific order.
4.3. Payment for the Goods shall be made using the methods specified on the website, including:
online payment by bank card;
payment to the current account;
cash on delivery;
other available payment methods.
4.4. The Buyer’s payment obligation shall be deemed fulfilled from the moment the funds are credited to the Seller’s account.
5. DELIVERY OF GOODS
5.1. Delivery of the Goods is carried out within Ukraine and internationally through delivery services specified on the website.
5.2. The cost and delivery time are determined according to the carrier’s tariffs and are communicated to the Buyer when placing the order.
5.3. The risk of accidental loss or damage to the Goods passes to the Buyer from the moment the Goods are handed over to the carrier.
5.4. The Buyer is obliged to inspect the Goods upon receipt.
6. RETURN AND EXCHANGE OF GOODS
6.1. The Buyer has the right to return or exchange the Goods in accordance with the Law of Ukraine “On Consumer Protection”.
6.2. Returns or exchanges are possible within 14 (fourteen) days from the moment of receiving the Goods, provided that:
the product retains its original commercial appearance;
there are no signs of use, damage, stains, or foreign odors;
protective seals, labels, and packaging are preserved.
6.3. Goods made to order for a specific customer or customized according to individual parameters cannot be returned.
6.4. Return shipping costs are paid by the Buyer unless otherwise specified in the terms.
6.5. Refunds are issued after the Seller receives and inspects the Goods, within 7 (seven) days.
7. RIGHTS AND OBLIGATIONS OF THE PARTIES
7.1. The Seller is obliged to:
deliver Goods of proper quality to the Buyer;
provide accurate information about the Goods.
7.2. The Buyer is obliged to:
timely pay for and receive the order;
provide accurate personal data.
7.3. The Seller has the right to:
change prices and the terms of this Agreement;
refuse to fulfill an order in case of violation of the terms by the Buyer.
8. LIABILITY OF THE PARTIES
8.1. The Parties shall be liable in accordance with the current legislation of Ukraine.
8.2. The Seller is not responsible for:
delivery delays caused by the carrier;
improper use of the Goods by the Buyer.
9. FORCE MAJEURE
9.1. The Parties are released from liability for non-performance of obligations in case of force majeure circumstances.
9.2. Such circumstances include: war, emergencies, disruptions in transport, communications, and others.
10. OTHER CONDITIONS
10.1. The Seller has the right to change the terms of this Agreement without prior notice.
10.2.The new version of the Agreement becomes effective from the moment it is published on the website.
10.3. Relations between the Buyer and the Seller are governed by the legislation of Ukraine.
